General terms and conditions

These reservation conditions govern the legal relationships between travelers and the Pays du St-Bernard Association (PSB) as well as PASS Saint-Bernard Sàrl.

1. CONTRACT CONCLUSION AND SERVICES

The contract between the customer and PSB is concluded through the unconditional acceptance of the reservation. These reservation conditions apply to all participants of the reservation.

The services correspond to the service description on the internet and the reservation confirmation. The number of persons specified in the contract must be adhered to in all cases (otherwise the contract can be terminated without compensation).

2. PAYMENT AND CANCELLATION CONDITIONS

The following payment and cancellation conditions apply:

2.1. Accommodation Reservations

Payment for the reservation is made according to the provider’s terms at the time of booking. Any changes or cancellations must be communicated to the provider. Any reservations canceled outside the deadline, as well as no-shows, will be charged.

2.2. Package Reservations

Packages are organized by PSB with local providers. Payment for the reservation is made directly to PSB by credit card. Changes or cancellations must be reported to PSB. The cancellation and payment conditions of the package stated at the time of booking apply. The amount paid includes all services included in the package. Any additional services must be paid directly to the providers upon departure.

2.3. Reservation of Activities/Events/Tickets/Other Products

The total amount for booking one or more activities/events/tickets/other products is payable directly at the time of reservation to PSB by credit card or other online payment methods. Any changes or cancellations must be reported to PSB. The cancellation and payment conditions stated on the reservation confirmation of each product apply.

3. LATE ARRIVAL/EARLY DEPARTURE

The customer is responsible for their arrival. No refund will be given in case of late arrival due to personal reasons or disruptions and delays in private and public transport (including trains, planes, etc.). In the case of early departure, the total amount remains payable.

4. CHANGES BY PSB

Before concluding the contract, the offered services and prices may be changed. After the contract has been concluded, PSB can change the services and offer substitute services before and during the stay in the event of unforeseeable and unavoidable circumstances. In case of the introduction or increase of taxes, fees, tourist taxes, or transport costs, a price change is possible up to three weeks before the start of the trip. In the event of force majeure, natural disasters, or other reasons making the execution of the contract impossible or endangered, PSB may terminate the contract with a refund of the unused services (any claim for damages is excluded).

5. COMPLAINTS

If defects are detected upon arrival or later, if the customer suffers damage, or has another reason for complaint, the provider (owner) must be informed immediately. PSB cannot be held liable in any case.

6. PSB LIABILITY

To the extent that applicable laws or agreements limit or exclude liability, PSB assumes liability only within the scope of these laws or agreements. PSB accepts no liability, especially for damages caused by customers, their companions, or third parties, in case of force majeure or other unforeseeable or unavoidable circumstances despite all due diligence. Liability for loss, theft, or damage to valuables such as jewelry, cash, credit cards, furs, photo and video cameras, telecommunication devices, etc., is explicitly excluded. For non-contractual liability, the legal provisions apply unless these reservation conditions provide other limitations or exclusions of liability.

7. CUSTOMER LIABILITY

The customer is responsible for the careful use of the rented object. The customer is liable for damages caused by them or their companions. The provider may assert their rights regarding the damages caused even after the return of the object.

8. SPECIAL CONDITIONS FOR THE PASS SAINT-BERNARD

8.1. General

The PASS Saint-Bernard is personal, non-transferable, non-refundable, and non-exchangeable. In case of bad weather or operational interruptions, subscriptions will neither be taken back nor refunded. Special conditions apply in case of closures due to an epidemic/pandemic.

8.2. Prices

The prices for the PASS Saint-Bernard include VAT according to the information provided on this page.

8.3. Child Rates

Children pay the same rates according to their year of birth:

  • Validity of the PASS from 2024: payable for children born in 2018 and older
  • Validity of the PASS from 2025: payable for children born in 2019 and older
  • Validity of the PASS from 2026: payable for children born in 2020 and older
  • Validity of the PASS from 2027: payable for children born in 2021 and older

8.4. Keycard

The PASS Saint-Bernard is stored on a keycard. The price of this keycard is CHF 5.- and is non-refundable but reusable.

8.5. Ordering and Payment

The PASS Saint-Bernard can be ordered either through the online form, the downloadable paper form, or directly at a counter. Online ordering on this website is only possible if the customer does not have a Keycard or wishes to purchase the special PASS Saint-Bernard Keycard for CHF 5.-. Transactions made on this website are secure. All information exchanged for payment processing is encrypted thanks to the SSL protocol. This data cannot be recognized, intercepted, or used by third parties. They are also not stored on this website. Accepted payment methods are: Visa, MasterCard, and Twint. Orders through the paper form are processed by mail. The customer is asked to enclose their Keycard with a passport photo for each person. They must pay the total amount according to the payment slip attached to the paper form or the bank details also indicated on the form. They will receive their Keycard only after payment and if the paper form is complete. To be registered, your order must be fully paid. Unpaid orders will not be delivered.

8.6. Exclusion

The PASS Saint-Bernard cannot be used as a subscription for the journeys of apprentices and students in secondary schools.

8.7. Fraud and Violations

The PASS Saint-Bernard is personal, non-transferable, and non-refundable. In case of misuse, the provider who detected the violation applies their own rules and charges an additional fee of up to CHF 200.- for the user and the subscription holder.

8.8. Cancellation Insurance

For CHF 9.- per PASS, PASS Saint-Bernard Sàrl guarantees the policyholder a proportional refund of the annual PASS Saint-Bernard for losses due to the inability to participate in an activity in the event of an accident or illness lasting more than 7 days or in the event of the insured’s death.

The insurance does not apply to the CHF 219.- PASS nor to the 4 Vallées + PASS Saint-Bernard subscriptions.

The insured is the holder of a PASS Saint-Bernard who has taken out and paid for cancellation insurance when purchasing their PASS.

The insurance coverage extends over the duration of the subscription, as indicated on the PASS Saint-Bernard.

Taking out cancellation insurance in no way guarantees coverage for damages and accidents caused by any of the following events:

  • Negligence by the insured despite existing official prohibitions;
  • Suicide or attempted suicide, self-mutilation;
  • All cases of force majeure making the fulfillment of the contract impossible, including prohibitions issued by local, national, or international authorities;
  • Improper or abusive use of the PASS Saint-Bernard;
  • Consequences of pregnancy from the 36th week.

All claims for refunds related to an incident must be sent to info@saint-bernard.ch within 10 days. The original or a readable copy of the PASS Saint-Bernard as well as proof of the incident, particularly the medical certificate or another document proving the validity of the guarantee, must be attached to the claim.

If the insured culpably fails to comply with this obligation, PASS Saint-Bernard Sàrl is not obliged to provide compensation.

9. Sending Newsletters and Emails

PSB sends newsletters by email. If you wish to subscribe to this service, please note that all emails are sent unencrypted, meaning that this data can be intercepted and read by third parties.

10. Unsubscribing from the Newsletter (Opt-Out Policy)

Unsubscribing from the PSB newsletter is possible at any time. Each newsletter contains a direct link that allows for an automatic and easy unsubscribe.

11. Modification of the General Terms and Conditions

PSB reserves the right to change the General Terms and Conditions at any time.

12. Data Protection

PSB undertakes to treat customers’ personal data respectfully and securely in accordance with Swiss data protection laws. Personal data may be used for sending marketing information related to Pays du St-Bernard, and only if the email address is provided in the written form. For online orders, the customer can register and thus accept the receipt of marketing information.

13. Applicable Law and Jurisdiction

Swiss law applies to the legal relationships between the customer and PSB.

The invalidity of certain contractual provisions does not lead to the invalidity of the entire contract. Exclusive jurisdiction in the event of a dispute: Orsières (Canton of Valais).
